Leonardo DiCaprio faces a $45-million lawsuit for allegedly inciting a 1998 attack against 41-year-old screenwriter and actor Roger Wilson.

Lawyers for the “Titanic” actor tried to have the case tossed, but an appeals court upheld an earlier decision by a lower court that lets accusations against the star stand. Leonardo is accused of “aiding and abetting an assault and battery” in the attack on the former boyfriend of “Showgirls” actress Elizabeth Berkley.

Seems that while hanging out with pals at New York’s Asia de Cuba restaurant on March 4, 1998, Leo noticed Berkley and acted very flirtatious. Wilson wasn’t happy, and the situation turned into a brawl outside the restaurant, with DiCaprio allegedly shouting “Let’s go kick his ass!”

Last year, a judge dismissed a claim that Leonardo actually took part in the attack, but what the actor said and did while his pals beat on Wilson is now at issue — and it could end up costing the teen heartthrob a pretty penny.
