Disgraced comic Bill Cosby is finally heading to a Pennsylvania court on criminal charges — after an appeals court rejected his attempt to get off the hook in a 2004 sexual assault case. Cosby's lawyers had been insisting that he had been immune from prosecution after settling a civil lawsuit that had been filed by victim Andrea Constand!

The settlement was made long before Cosby saw his career destroyed by at least 40 women accusing him of sexual assault — including “America’s Next Top Model” judge Janice Dickinson (seen here with attorney Lisa Bloom). The stories frequently involved Cosby getting the woman to drink something that was laced with a drug that would allow Cosby to take advantage of her!

Cosby’s legal team had argued that the comedian made an agreement with former Montgomery County District Attorney Bruce Cabot in 2005 that meant the comic was immune from prosecution forever. Cosby's attorneys said that Castor believed the Constand case was too weak to win, and promised there would never be any prosecution.

Current DA Kevin Steele — who campaigned against Castor while promising to prosecute Cosby — countered that the former DA had no legal authority to make that kind of guarantee. Various judges had ruled on the challenge, but this latest decision by the mid-level state Superior Court seems set to put Cosby on trial!

Most of the charges of sexual assault against Cosby are too old to be taken to court. DA Steele was able to file charges on behalf of Andrea shortly after being elected. Cosby is also still facing several lawsuits filed by older victims (including Janice) charging him with defamation — as the 78-year-old entertainer tries to salvage his reputation by claiming they're falsely accusing him of rape.

In California, however, the statute of limitations for child sexual abuse begins to run from the date that a victim “discovers” her injury.
