David Gest‘s $10 million civil assault lawsuit against estranged wife Liza Minnelli was thrown out of State Supreme Court in New York. Gest, a music producer, claimed Minnelli beat him so badly during alcoholic rages that he had to be hospitalized. The judge dismissed the suit though, after Minnelli’s medical expert made it clear that Gest’s headaches were caused by a strain of herpes. Gest plans to appeal the ruling and his lawyer says he tested negative for the virus.
