Some good news for troubled actor Robert Downey Jr. this week — he won’t have to go back to prison before going to court for his most recent drug charges.

A Malibu judge determined Downey had spent enough time in prison for his prior probation violation and wished him good luck. A very nice holiday season sentiment, but it has no bearing on his most recent arrest on Thanksgiving weekend.

Downey is expected to plead not guilty when he returns to court in Indio, California on December 27. If convicted on the latest drug possession charges, he could end up spending four years and eight months in the slammer.

He was arrested November 25 after police caught him with drugs at the Merv Griffin Resort in Palm Springs.
