Larry Birkhead, who claims to be the father of Anna Nicole Smith‘s newborn daughter, has filed a lawsuit demanding Smith and the baby return to California for paternity testing, his lawyer said. Birkhead’s lawyer, Debra Opri, said the suit was filed Monday in Los Angeles Superior Court because Smith has not responded to Birkhead’s attempts to communicate. “The access had been cut off about the time of the birth of the child,” she said. “There are concerns about the health and safety of the child,” Opri also said. “These are things that will come out in court.” Anna Nicole has not publicly announced the identity of the baby’s father, but Anna’s lawyer Howard K. Stern, claimed he is the father on Larry King Live last week.
