Britney Spears trial for driving without a valid California license is moving forward.

Her attorney, J. Michael Flanagan, is not too happy it. He claims the matter is going before a jury due to unfavorable "special treatment" by prosecutors and the judge.

Because the violation is a misdemeanor rap Brit is not required to appear.

The judged also rejected Flanagan’s attempts to get the cased dismissed.

Flanagan argued that under normal circumstances Spears should be allowed to just pay the $10 fine and not face prosecution.

City prosecutor Michael Amerian is accused of propelling a simple traffic case forward into the spotlight because he is currently running for City Attorney.

"We’re trying to treat her as we have anyone else who’s been charged with a hit-and-run as well as driving without a valid license," Amerian said.

Drivers are supposed to get a California license within 10 days of establishing residency in the Golden Gate state.

The case has been postponed repeatedly because of Brit’s public meltdown, hospitalizations, custody battles and finally the legality of father James’ conservatorship.
