Claims 'justifiable homicide' after Saints player shot in road rage incident!

The nation is still mourning the shooting death of NFL star Will Smith on April 9 — but an attorney says that the popular New Orleans resident deserved to die!

On the night of the shooting, the former Saints defensive end (seen here holding his 2007 ESPY Award with teammate Scott Fujita) was driving with his wife Racquel in the Lower Garden District of New Orleans.

A vehicle driven by 28-year-old Cardell Hayes rear-ended Smith’s SUV and caused a multiple collision with the vehicle in front of him.

Words were exchanged, and witnesses said that Hayes — who had been arrested in 2010 for possessing both drugs and firearms — then shot Smith, and also shot Racquel twice in the leg.

Tanzanike Ruffin is the attorney Kevin Oneale, who was Hayes’ passenger in the car — and he’s declared that Smith’s death saved his client’s life!

“Smith had a gun and was going to shoot it,” declared Ruffin, “and Cardell may have saved both of their lives … in my mind, this is justifiable homicide!”

The New Orleans Police Department has confirmed three loaded weapons were found in the aftermath of the automobile accident.

A loaded gun was in Smith’s SUV, and the other two weapons came from the Hummer being driven by Hayes.

The only gun that had been fired was in Hayes’ possession.

Hayes’ attorney, John Fuller, has also said that Hayes will be proven innocent because he had actually called 911 to report that he had been the victim of a hit-and-run before he rear-ended Smith’s SUV.

Police department records, however, showed no record of a similar 911 call being made at the time in the area.
