Attorneys for love starved astronaut Lisa Nowak who drove 10000 miles without a stop wearing a diaper to bitch slap a love rival wants one of the charges dismissed.
Nowak’s attorney’s want one of three criminal charges specifically "burglary with an assault or battery with a weapon."
Team Nowack says the charge doesn’t apply because she never used the pepper spray on her intended vic in the steamy love triangle.
Law enforcement charge the former space shuttle astronaut drove from Houston to Orlando in February 2007 to abduct Air Force Captain Colleen Shipman, who was dating Nowak’s ex- BF shuttle commander Bill Oefelein.
The other charges pending are attempted kidnapping and battery with assault. Nowak’s trial begins December 7th – a day in space infamy.
