HOWARD K. STERN FILES ANNA’S WILL, BIRKHEAD WANTS CONTROL OF DANNIELYNN’S ESTATE

Anna Nicole Smith‘s 2001 will was filed on Monday, four months after the model/actress died of an accidental drug overdose. Howard K. Stern filed the probate petition asking the judge to recognize the document as Smith’s last will and him as its main executor.

Anna’s assets — estimated at only $710,000 — were originally left to her son, Daniel, who died on September 10, 2006, just days after the Playboy Playmate gave birth to a baby girl in the Bahamas. In the probate petition signed by Stern on May 7, Anna’s daughter, Dannielynn, is named as her survivor.

Stern’s attorney said a trust will be created with Dannielynn as its sole beneficiary. Dannielynn could inherit the estate of Anna Nicole’s late husband, J. Howard Marshall II, estimated to be worth $500 million.

Dannielynn’s biological father, Larry Birkhead, also filed papers Monday asking a judge to appoint him as guardian of Dannielynn’s estate.

Both petitions are scheduled to be heard on June 19.
