Larry Birkhead and Howard K. Stern left probate court on Tuesday with Howard K. named as the executor of Anna Nicole Smith's 2001 will and Larry Birkhead as legal guardian of Dannielynn.

The will named Smith's son Daniel as Anna Nicole's only beneficiary, but a lawyer in court said he had spoken with the attorney who drafted the will and at the time Anna did not plan on having anymore children, but said if she did that she would want them to have a share.
